山寨文化是否健康
“Shanzhai” first became a name for fakes afterShanzhai cell phones’ popularity in the market. Nowit has been given a broader meaning of fake,unprofessional or homemade, and a slang foranything that steals ideas or styles from already well-known stuff. Some believe that “Shanzhai” hasbecome a culture of its own and it represents non-mainstream ideas and innovations.
隨著山寨手機的流行，山寨成為了假冒產(chǎn)品的代名詞。如今，山寨又有了假冒、不專業(yè)以及國產(chǎn)的更為廣泛的意義，它也成為了偷去別人想法，偷取著名產(chǎn)品樣式的俚語。許多人認為山寨已經(jīng)有了自己的文化，它代表了非主流的想法和創(chuàng)新。
However, from my viewpoint, it is not a healthy culture but piracy.Shanzhai comes from copyingand plagiarizing and often infringes on intellectual property (IP) rights. For example, imitatedelectronics, including cell phones, MP3s and even laptops, are the most common “Shanzhai”products. Despite the possible infringement of IP rights, they are much liked by many people asa good way to spend less. However, consumers’interests should not be at the expense oflegitimate IP right holders. IP right laws are there to protect the interests of patent,copyrightand trademark holders for a limited period of time. They are devised not only toreward innovators, but also to encourage further creativity. If illegal Shanzhai is not heldaccountable, society is rewarding copycats while punishing innovators. The result could bedisastrous: Everyone will choose to copy others.
但是，我認為山寨不是一種文化，而是一種盜版行為。山寨通常是來源于復(fù)制和剽竊，通常都會侵犯他人的知識產(chǎn)權(quán)。例如相似的電子產(chǎn)品，包括手機、MP3，甚至是筆記本都擁有山寨產(chǎn)品。盡管它存在侵犯知識產(chǎn)權(quán)的可能，但是人們依然對它們情有獨鐘。但是，消費者的利益不能夠以侵犯讓他人的知識產(chǎn)權(quán)為代價。知識產(chǎn)權(quán)法是為了保護專利人、版權(quán)所有人以及商標人的權(quán)利。法律的設(shè)置不僅能夠讓創(chuàng)新者獲益，還能鼓勵更多的創(chuàng)新。如果山寨對此不負責任的話，那么社會將會鼓勵復(fù)制，而非創(chuàng)新。那么，結(jié)果將會是災(zāi)難性的，每個人都會選擇去復(fù)制他人。
The market will be flooded with the same kind of poorly-designed and badly-made products thathave short lives and lack after-sale services.From the above discussion, we can see clearly thatShanzhai culture is not a healthy one. It violates IP rights and undermines market competitionorder under the disguise of grassroots culture.
市場上充斥著許多設(shè)計質(zhì)量差，制作粗糙的產(chǎn)品，產(chǎn)品的壽命短，并且缺少售后服務(wù)。從上述討論中看出，我們能夠清新地指出山寨文化并不健康。山寨侵犯了他人的知識產(chǎn)權(quán)，并損害了市場競爭。
