2014年兩會：張德江人大常委會工作報告要點（中英對照）

Over the past year, the standing committee deliberated 15 bills and draft decisions on legal issues, of which 10 of them were passed; and revised 21 laws and enacted two.

一年來，常委會審議了15件法律和有關法律問題的決定草案，通過了其中的10件；涉及修改21部法律，新制定2部法律。

Over the past year, the standing committee listened to and deliberated 15 work reports of the state council, the supreme people's court, and the supreme people's procuratorate, inspected the implementation of four laws, conducted three special inquiries and carried out five special investigations and studies.

一年來，常委會共聽取審議國務院、最高人民法院、最高人民檢察院15個工作報告，檢查4部法律實施情況，組織開展3次專題詢問和5次專題調研。

The standing committee divided npc deputies into 260 groups and supported them to solicit people's opinions and requests through a variety of ways.

常委會組建260個全國人大代表小組，支持代表小組積極開展活動，通過多種方式聽取和反映人民群眾的意見要求。

A total of 1,740 deputies took part in investigations and studies on special topics and 1,700 deputies in inspection tours.

組織1740名代表參加專題調研，1700名代表參加集中視察。

Each member of the chairperson's council was asked to keep direct contact with at least five npc deputies.

研究制定委員長會議組成人員聯系全國人大代表的意見，明確委員長會議組成人員分別直接聯系5名以上全國人大代表。

The number of deputies sitting on the meeting of the standing committee was raised to 66.

進一步擴大代表對常委會、專門委員會工作的參與，列席每次常委會會議的代表人數增加至66名。

A total of 51 entries in 169 motions put forward by npc deputies were incorporated in legislative programs and plans.

注重把審議代表議案同立法工作結合起來，認真梳理分析代表議案比較集中的立法項目，將169件議案提出的51個項目列入立法規劃和立法計劃

The top legislature enacted the tourism law and the special equipment safety law, as well as amended the law on the protection of consumers' rights and interests.

為促進旅游業持續健康發展，常委會制定旅游法，重點保障旅游者的合法權益。

It revised 19 laws to facilitate the institutional reform of the state council, which was adopted at the first annual session of the npc.

委員長會議審議通過委員長會議組成人員貫徹落實中央八項規定實施辦法，從改進調查研究等六個方面做出19條具體規定。

It adopted resolutions to abolish the system of reeducation through labor and allow couples to have second child if either of them is single child.

常委會經過認真審議，通過關于廢止有關勞動教養法律規定的決定。通過關于調整完善生育政策的決議，啟動實施一方是獨生子女的夫婦可生育兩個孩子的政策。

It ratified two new national days, one to mark victory in the anti-japanese war and the other to commemorate nanjing massacre victims and all those killed during japanese aggression against china.

通過有關歷史紀念日的決定，進一步弘揚愛國主義精神。審議通過了關于確定中國人民抗日戰爭勝利紀念日的決定、關于設立南京大屠殺死難者國家公祭日的決定。

NPC deputies, experts, industry insiders and ordinary citizens were invited to assess the feasibility and social effects of a motion before it was put for a vote.

邀請部分全國人大代表、旅游者和旅游經營者、專家學者召開座談會，對法律草案內容的可行性、法律出臺時機以及實施后的社會效果等進行綜合評估，為立法決策提供參考。

The top legislature added one round of opinion soliciting after the second reading of a motion.

在向社會公布法律草案一次審議稿的基礎上，明確法律草案二次審議稿也要向社會全文公布，繼續廣泛征求各方面意見和建議。

2013年監督工作

The top legislature strengthened the supervision on budget and final account of the central government. it examined the reports on the central government's final accounts and auditing work in 2012 as well as the implementation of the budget for the first seven months of fiscal year 2013.

常委會聽取審議2012年中央決算報告和審計工作報告，審查批準2012年中央決算，在8月份的常委會會議上聽取審議前7個月預算執行情況的報告。

The top legislature examined a report on the government spending on science and technologies, which was the first time it oversaw the government spending for a specific purpose.

常委會聽取審議關于國家財政科技資金分配與使用情況的報告。重點就某一具體領域財政資金的使用情況開展監督，這在常委會監督工作中還是第一次，是對深化財政預算監督的有益嘗試。

It examined 19 new regulations of the state council and 32 legal interpretations of the supreme people's court and the supreme people's procuratorate in the past year, to determine if they were in line with the constitution and laws.

常委會對國務院新制定的19件行政法規，最高人民法院、最高人民檢察院新制定的32件司法解釋，逐件逐條進行審查，對審查中發現的同憲法和法律相抵觸的問題，督促制定機關及時修改或廢止。

It reviewed all existing judicial interpretations and other documents with similar effect. this is the first such review since the founding of the people's republic of china.

上屆常委會部署的司法解釋集中清理工作，是新中國成立以來首次對現行有效的司法解釋和司法解釋性質文件進行全面集中清理。

 

What to Do in 2014

2014年主要任務

The top legislature will revise the budget law to improve the budget management system.

修改預算法，改進預算管理制度。

It will amend the administrative procedures law and the law on administrative review to facilitate cases of administrative litigation and reconsideration and correct illegal or improper administrative actions.

修改行政訴訟法、行政復議法，健全行政訴訟案件、行政復議案件審理機制，糾正違法或不當行政行為，健全暢通有序的權益保障機制。

It will revise the environmental protection law and the air pollution prevention and control law to improve environmental protection and curb pollution.

修改環境保護法、大氣污染防治法，完善嚴格監管所有污染物排放的環境保護管理制度。

Lawmakers will inspect the implementation of the tourism law and the patent law.

檢查旅游法、專利法的實施情況，推動法律全面正確實施。

They will review the country's economic and social development plan, the central and local government budgets as well as the final accounts and auditing work of the central government.

聽取審議計劃、預算報告以及中央決算報告和審計工作報告。

They will hear and approve the central government's final accounts for 2013.

審查批準2013年中央決算。

The state council will submit a report on conserving energy and reducing emissions for review.
